Documentation for the Visa Digital Benefits Platform (“VDBP”) includes, but is not limited to, the Visa Digital Benefits Platform Service Description (including all documents incorporated therein by reference).
The VDBP Application Programming Interfaces (“VDBP APIs”) are accessible by and available to Issuers and service providers who have entered into an agreement to provide technology development services on behalf of financial institutions (“Service Providers”). Non-Members may only use VDBP after being designated a Third-Party Agent (as defined in the Visa Rules) of a Visa Member that has access to VDBP. Each individual Issuer or Service Provider shall be known as “Company” in these terms.
Company represents and warrants that it has all necessary third-party permissions, including where applicable, from the Cardholder (as defined in the Visa Rules) and/or Issuer, to authorize Visa to provide Company with VDBP and the related benefit information.
Company shall not extract current Visa benefit information accessible from VDBP, including, without limitation, merchant trademarks, logos, images, benefit details and terms and conditions thereof (collectively, the “Benefit Content”) except in accordance with these terms to display such Benefit Content on Company’s own website, social channels and/or mobile applications (“Company Channels”) using the VDBP APIs, as provided to Company by Visa.
Except for layout and image sizing/scaling to fit the appropriate screen, all Benefit Content displayed on Company Channels must remain as-is including, but not limited to, the referenced Issuer, and no other modifications can be made without Visa’s prior written approval.
Company represents and warrants that Benefit Content promoted through Company Channels to Visa cardholders is identical and limited to the targeted jurisdiction by Company for which the Benefit Content is designated.
Company represents and warrants that Benefit Content promoted through Company Channels to Visa cardholders is compliant with applicable laws and regulations in Company’s jurisdiction as well as the jurisdiction where the Benefit Content is being provided.
